A question that many women have is, “Is there a lawsuit against essure sterilization?” The answer is yes. There have been several. Not all of them are successful. But many are, and the fact that there are some lawsuits means that women have rights too!

One lawsuit was brought by a group of women who say that Essure cut into their constitutional rights. They say that the procedure deprived them of their right to receive an abortion. This argument is partially valid. As we all know, it is against the law to perform a procedure on a patient without her consent or understanding. But what about a woman who has not given any indication that she wishes to have children and yet Essure is performed? If she truly is a victim of sterilization abuse, then maybe this argument has some merit.

Another lawsuit was brought against the medical company that manufactured Essure. This time, the lawsuit claims that the company intentionally marketed the product as a safe and effective form of permanent birth control. This lawsuit also claims that the medical device company did not warn consumers of the possible complications associated with the Essure device. This may seem like an obvious point, but who really reads the fine print anyway?

Some people have accused companies of engineering a false reality about Essure and then marketing it as something else. But the Essure Company says that the claims in the lawsuits are “baseless and erroneous. The FDA has ordered the company to stop making these statements. Meanwhile, it is probably best for the consumer to continue asking the question “Is there a lawsuit against Essure?

In the meantime, what can you do? If your health insurance covers it, then by all means speak to your plan administrator about payment plans that may cover Essure. You may also want to check into a medical bill consolidation plan. If you cannot get your Essure payments through your employer, you should look into private medical insurance plans. You may be able to save a lot of money on rates if you use a high-deductible plan or if you go with a lower monthly premium.

Essure sterilization remains legal and the chances of you winning your lawsuit are still very strong. You can call your attorney, or you can file a suit in federal court. Both options give you the opportunity to gain a settlement for your Essure charges. The key is whether you want to settle out of court or take the case to the jury trial. You really need to decide this before you spend a lot of money on legal fees and if you still want to go forward with it.
