The Winco Foods lawsuit is a sad story that is sure to leave a mark on the memory of those that were unfortunate enough to be affected by the alleged wrongful acts of the defendant. For more than three decades, the company had been providing consumers with food products that were safe for consumption.

However, in June  the FDA and the state attorney general learned of the falsity of the claims that Winco made. The company was taken to task for these actions, and several members of the company’s management were placed under investigation. The case has been ongoing ever since, and the legal battle continues today.

Winco Foods Lawsuit

A Winco Foods lawsuit is nothing new. The attorney general of the State of New York, Eliot Spitzer, had brought the suit against Winco Foods after he discovered that the company had falsely billed the federal government as its customers’ health food supply. Instead of supplying them with this food, it had instead billed the government as a manufacturer of low-cost diabetic test strips.

When Spitzer’s investigation was released to the public, many people were surprised by what he found.

In fact, he had accused Winco Foods of engaging in “deceit, fraudulent concealment and false advertising,” among other things. Since the charges brought against Winco Foods involved deception, it was no surprise that the attorney general decided to sue them and take the company to court.

Although the company settled with the attorney general, other lawsuits have continued to surface.

One such lawsuit involved a woman who died from a heart attack while she was supposed to be taking a diabetes medication. After her death, her husband discovered that she had not been using a diabetes medication that would have kept her alive.

Another suit involved the use of unapproved ingredients in a number of Winco Foods products. As the lawsuit pointed out, if any company uses unapproved ingredients in their food products, that company can be held liable for injuries caused by these items.

Another Winco Foods lawsuit involves the use of irradiation in the production of some of their products.

The attorney general brought this suit after determining that Winco Foods was improperly processing radiation-grown carrots in their factory. Winco Foods argued that the only way that the radiation would harm humans was if someone ingested it, but the court ruled in their favor, citing scientific evidence. Regardless, the ramifications of this ruling are still being litigated.

As one might expect, any legal case can become quite complex and expensive.

However, Winco Foods lost their initial lawsuit and they’ve already spent more than $1 million in legal fees. This lawsuit represents the company at its worst and it’s easy to understand why it would be so difficult for them to successfully fight this second lawsuit.

After all, even if the radiation did not come into contact with the customers themselves, Winco Foods could still be facing a mountain of medical bills because of their shoddy work. This second lawsuit is expected to cost Winco Foods another millions and they’ll undoubtedly lose more money as a result of this entire mess. It will be fascinating to watch this company negotiate their way out of this predicament.
